HIPAA and HITECH

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) requires all covered entities (health plans, healthcare clearinghouses, and healthcare providers) to protect and guard against the misuse of an individual’s protected health information (PHI). The Health Information Technology for Economic and Clinical Health Act of 2009 (HITECH) strengthens the privacy and security protections under HIPAA, especially those related to the exchange of electronic PHI. Individuals may learn about their rights under HIPAA in Colorado Access’ Notice of Privacy Practices.
